These Terms of Use ("Terms") govern the use of the Vesunil appointment and service management platform (the "Platform") provided by Büşra Uçar Sönmez (sole proprietorship, DualyxLabs brand) (the "Platform Provider"). Any business that opens an account and any user who signs in to the Platform accepts these Terms.
Version: v2 · Last updated: 20 October 2026
1. Parties and definitions
- Platform Provider: Büşra Uçar Sönmez (sole proprietorship, DualyxLabs brand). Address: Mustafa Kemal Mah. Dumlupınar Bul. Tepe Prime C-Blok Kapı No: 71, Çankaya / Ankara, Türkiye. Tax office / number: Maltepe Tax Office /
- KEP address: busra.ucarsonmez@hs01.kep.tr. E-mail: info@vesunil.com.
- Business: The natural or legal person that opens an account in its own name and uses the Platform in its commercial activity.
- User: A person who signs in to the Platform on behalf of the Business, with the role of Business Admin (
BUSINESS_ADMIN) or Provider (PROVIDER). - Customer: A third party whose appointment, payment and contact records the Business keeps on the Platform. A Customer is not a Platform user and never signs in.
- Panel: The Platform's web interface.
- Account: The business account the Business opens on the Platform and the User accounts attached to it.
- KVKK: Personal Data Protection Law No. 6698.
- Data Processing Agreement: The document, forming an integral part of these Terms, that sets out the rights and obligations under Article 12 of KVKK for the personal data the Business records on the Platform.
When the User opens an account on behalf of the Business and accepts these Terms, an agreement is formed between the Business and the Platform Provider. The acceptance is recorded with the time of acceptance and the version of the accepted text.
The Platform is a business-to-business service, not a consumer application. By opening an account, the User declares that they are authorised to represent and bind the Business.
2. Registration and verification
Registration asks for the business name, full name, email address, phone number and a password. The form includes bot protection (CAPTCHA). The Business is responsible for the accuracy and currency of the information provided.
Once registration completes, a verification link is sent to the email address. The Platform cannot be accessed until verification is complete. Acceptance of these Terms and of the KVKK Privacy Notice is recorded at registration, together with the time of acceptance and the version of the accepted text.
Keeping sign-in credentials confidential is the User's responsibility. Unauthorised access must be reported to the Platform Provider without delay. A User can see their open sessions in the Panel and end any of them.
The Business is responsible for actions resulting from a User failing to protect their sign-in credentials or sharing them with third parties. From the moment unauthorised access is reported to it, the Platform Provider makes reasonable efforts to respond; without prejudice to intent and gross negligence, the Platform Provider is not liable for damages arising from unauthorised access that occurred before the report and is not attributable to the Platform Provider's fault.
3. Roles and permissions
- Business Admin: Manages the business profile, working hours, services, customers, appointments, payments, expenses, reports, messaging settings, files, users and activity records.
- Provider: Performs a limited set of tasks such as their own appointments, creating customers and recording payments.
- Platform Admin: The authorised user on the Platform Provider side, who manages business records, package and feature entitlements, integration settings, storage quotas and support records.
Adding users, assigning roles and revoking access are the Business Admin's responsibility. Closing the access of people who leave the Business belongs to the Business.
4. Trial, packages and feature entitlements
Every newly opened business starts with a 14-day free trial that begins at registration and runs with the Starter package feature set.
Platform features depend on packages. Entitlements such as appointments, blocked times, recurring appointments, payments, expenses, reports, messaging, SMS, WhatsApp, multiple users and a custom logo are opened or left closed according to the Business's package. The screen of a closed feature is not hidden in the Panel; it is shown in a locked state.
When the trial or a paid package ends, the Business's data is not deleted and remains readable; only creating and changing records is blocked. The remaining period is shown in the business settings.
5. Fees
Subscription packages and SMS credit packages are bought or renewed online by the Business administrator from the package and subscription screen in the Panel's Settings. The scope, duration and price of a package are shown on the purchase screen in Turkish lira (TRY); before confirming payment, the Business sees the amount to be charged and the effect of any discount code. Discount codes are subject to their own conditions.
Payment is made on the secure payment page of the payment institution iyzico. Card details are entered with iyzico; the Platform Provider does not receive, process or store card data. The purchased package period or SMS credit is credited to the account once, after the payment has been confirmed; a payment that is not completed or fails adds nothing to the account.
A purchase requires the Business to provide its invoice details (title, tax number and tax office, address, e-mail and phone). These purchases are made for the Business's commercial activity, so the distance-selling withdrawal rules of Consumer Protection Law No. 6502 do not apply. For cases such as the same amount being charged twice or an erroneous charge, and for requests concerning unused SMS credit, you may send a refund request to info@vesunil.com; requests are assessed on the information and records.
The payment screens inside the Panel are separate: they exist to record amounts the Business physically collects from its own customers and are unrelated to payments made to the Platform Provider.
6. The Business's obligations
The Business is responsible for the lawfulness of the data it enters and the operations it runs on the Platform. In particular, the Business shall:
- Meet its data controller obligations under Personal Data Protection Law No. 6698 when entering personal data about its own customers. This relationship is set out in the Data Processing Agreement.
- Understand that the national identification number field on a customer record is optional, and process that data only where it is genuinely needed.
- Act in the knowledge that entering special categories of personal data (including health data) into free-text fields such as customer notes creates additional legal obligations.
- Comply with consent, İYS registration and content rules for the SMS, WhatsApp and email messages sent to customers. See the Commercial Electronic Messages and İYS document for detail.
- Be responsible for the content of, and its right to upload, any file placed on the Platform.
7. The Business's indemnity
The Business shall indemnify the Platform Provider for documented losses and reasonable legal and court costs that the Platform Provider incurs because of claims, lawsuits and administrative sanctions brought against the Platform Provider by third parties or competent authorities and arising from the data the Business enters into the Platform, the content of the messages it sends to its customers, or a breach of these Terms or of applicable law. The Platform Provider notifies the Business of any such claim without delay, and the Business cooperates reasonably in defending it. This section does not cover losses arising from the Platform Provider's own fault or from its breach of its data processor obligations.
8. Messaging and integrations
The Platform supports notifications over SMS (İleti Merkezi, Verimor), the WhatsApp Cloud API and email. Whether these channels work depends on the relevant provider's service, rules and approvals.
SMS and WhatsApp credentials can be configured per business. They are stored encrypted and shown masked in the Panel. Provider-side balance, sending limits, template approval and number verification requirements are the Business's responsibility.
The Platform Provider is not responsible for delivery if a provider fails to deliver a message, delays it or restricts an account. Sending and delivery states are recorded in the Panel.
9. File upload and storage
The Business can upload business documents, a logo, profile photos and support attachments through the Panel. Each business has a storage quota (250 MB by default) and new uploads are blocked once it is full. Quota increases are performed by the Platform Provider.
Business documents and support attachments are stored privately; logos and profile photos are served over a stable link so that they can be displayed in the Panel.
When a customer list is bulk imported from an Excel file, the uploaded file is not stored permanently; only the imported records remain.
10. Prohibited uses
- Using the Platform unlawfully or in a way that infringes third-party rights.
- Attempting to access data without authorisation, attempting to cross tenant boundaries, or attempting to bypass security measures.
- Reverse engineering the source code, sending excessive automated requests, or disrupting the operation of the service.
- Reselling the Platform or offering it as a service to third parties without permission.
- Sending commercial electronic messages to recipients who have not consented.
11. Intellectual property
The Platform's software, interface, source code, design and brand belong to the Platform Provider (or its licensors). The Business is granted a personal, non-transferable, non-sublicensable and non-exclusive right to use the Platform in its commercial activity for the duration of the agreement, in accordance with these Terms; rights not expressly granted in these Terms are reserved. These Terms transfer no rights other than this right of use.
Data the Business enters into the Platform belongs to the Business. The Platform Provider processes it only to provide and maintain the service and to carry out the operations the Business requests.
12. Service continuity and changes
The Platform Provider makes reasonable efforts to provide the service without interruption; temporary outages may occur due to maintenance, updates or causes beyond its control. Planned maintenance is announced in advance where possible.
The Platform is provided as is and as available. The Platform Provider does not warrant that the Platform will be uninterrupted, error-free or suitable for every specific need of the Business; in particular, delays caused by third-party providers, provider restrictions and the Business's own internet connection, and other causes beyond The Platform Provider's control, do not give rise to liability on the Platform Provider's part. Intent and gross negligence, and the mandatory provisions of law, are reserved.
The Platform Provider may improve, change or remove Platform features. Changes that significantly affect the Business's use are communicated beforehand.
13. Force majeure
Events beyond the reasonable control of the parties are treated as force majeure, such as natural disasters, war, epidemics, failure of electricity or electronic communications infrastructure, a cyber attack that occurs despite the Platform Provider's reasonable security measures, decisions of public authorities, and failures of hosting or SMS and WhatsApp providers that are beyond control. For the duration of force majeure, the affected party is not liable for the obligations it affects and notifies the other party without delay. The Business's payment obligations that accrued for the period in which the Platform was available are not affected by force majeure.
If force majeure lasts more than thirty days, either party may terminate the agreement by notice. In that case, the package fee the Business paid in advance for the unused period is refunded, subject to any separately agreed terms between the parties.
14. Limitation of liability
The Platform is a business management tool; it is not legal, financial, tax or health advice. The Platform Provider is not responsible for the outcome of decisions taken in reliance on the data or reports in the Platform.
To the extent permitted by law, the Platform Provider is not liable for indirect damages, loss of profit, indirect consequences of data loss, or interruptions in third-party providers' services.
To the extent permitted by law, the Platform Provider's total liability arising from these Terms is limited to the fees the Business paid to the Platform Provider in the twelve months before the event giving rise to the damage; multiple claims do not increase this limit. This limitation does not apply to damages arising from the Platform Provider's intent or gross negligence, to mandatory liabilities under personal data protection legislation, or to other liabilities that the law does not allow to be limited. For accounts in the trial period, the Platform Provider's liability is limited, to the extent permitted by law, to direct and documented damages.
15. Suspension and termination
The Business may stop using the service at any time. Deletion of the account and its data is requested as described in the Account and Data Deletion document.
The Platform Provider may suspend access or terminate the agreement in the event of a serious breach of these Terms, unlawful use, conduct that threatens security, or failure to meet payment obligations. Prior notice is given where possible, along with a reasonable period to export data.
After the agreement ends, the following remain in force: payment obligations that arose before termination (Section 5), the indemnity (Section 7), intellectual property (Section 11), the limitation of liability (Section 14), electronic records and evidence (Section 20), governing law and disputes (Section 21), and any other provisions that by their nature must continue. Retention and deletion of data after the end of the agreement are subject to the Account and Data Deletion document.
16. Support
Support requests and feedback can be submitted from the support screen in the Panel. Scope and response expectations are described in the Support document.
17. Changes to these Terms
The Platform Provider may update these Terms. Significant changes are communicated through the Panel and re-acceptance of the current text may be required. Every version is published at this address and carries a version number and date.
A Business that does not accept a change may, before the change takes effect, stop using the service and end the agreement under Section 15, and export its data through the Panel. A change does not affect rights and obligations that arose before its effective date.
18. Entire agreement, severability and no waiver
These Terms, together with any separately agreed package and fee terms and the Data Processing Agreement, the Commercial Electronic Messages and İYS document, the Cookies and Local Storage Notice, the Account and Data Deletion document and the Support document, form the entire agreement between the Business and the Platform Provider. The Privacy Policy and the KVKK Privacy Notice are information notices and apply alongside these Terms. If these Terms conflict with the Data Processing Agreement on the processing of personal data, the Data Processing Agreement prevails.
If any provision of these Terms is found invalid or unenforceable, the validity of the other provisions is not affected; the parties agree to replace the invalid provision with the valid provision closest to its purpose. The Platform Provider's failure to exercise a right does not mean it has waived that right.
19. Assignment
The Business may not assign its rights and obligations under these Terms to a third party without the Platform Provider's prior written consent. In the event of a merger, demerger, change of legal form or transfer of business, the Platform Provider may assign its rights and obligations under these Terms, provided that the successor continues the commitments on protecting the Business's data and the Data Processing Agreement, and the Platform Provider notifies the assignment through the Panel or by email. A Business that objects to the assignment may end the agreement under Section 15 from the date of the notice.
20. Electronic records and evidence
In disputes between them, the Business and the Platform Provider agree, under Article 193 of Civil Procedure Law No. 6100, that records kept on the Platform, confirmations (including the time of acceptance and text version), activity logs, message sending states, delivery states received from providers and activity records are valid evidence until proven otherwise. This section is an evidence agreement between the Business and the Platform Provider; the right to submit counter-evidence is reserved, and the mandatory provisions of law and public order are not affected. It does not bind the Business's customers or other third parties.
21. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Ankara (Çankaya) have jurisdiction over disputes.
The parties first try to resolve any dispute between them in good faith by written notice to info@vesunil.com; if no resolution is reached within thirty days of the notice, the parties may apply to the competent court. For disputes where the law makes mediation a precondition to suit, mediation is attempted first. This section does not limit the urgent protection and interim injunction rights recognised by law.
